Terms of Service

These Terms of Service form a legally binding agreement between you and SurSolver ("SurSolver", "we", "us" or "our"). Please read them carefully before using the Service.

In these Terms, the following definitions apply:

• "Account" means the account registered by you to access and use the Service.
• "API Key" means any credential issued to an Account for authenticating requests to the Service.
• "Balance" means the prepaid credit held on an Account and consumed through use of the Service.
• "Output" means any answer, token or other result returned by the Service in response to a Task.
• "Service" means the SurSolver captcha-solving service, including our website, application programming interface (API), documentation and any related software or tools.
• "Task" means any captcha or related request submitted by you to the Service.
• "Terms" means these Terms of Service, as amended from time to time under Section 20.
• "Third Party" means any person or entity other than you and SurSolver.
• "You" and "your" mean the individual using the Service and, where Section 01 applies, the organisation on whose behalf that individual acts.

In these Terms, headings are for convenience only and do not affect interpretation; the words "including" and "include" mean "including without limitation"; and the singular includes the plural and vice versa.

1.1 By registering an Account, clicking to accept these Terms, or accessing or using the Service in any way, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

1.2 If you use the Service on behalf of a company or other organisation, you represent and warrant that you have full authority to bind that organisation to these Terms. In that case, "you" refers to both you and that organisation, which shall be jointly and severally liable for your compliance with these Terms.

2.1 SurSolver provides an API-based captcha-solving service. You submit a Task to the Service and we use reasonable efforts to return an Output for that Task.

2.2 The Service is intended solely for lawful purposes, including legitimate automation, quality assurance, research and accessibility workflows.

2.3 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR NON-INFRINGEMENT. We make no commitments other than those expressly set out in these Terms.

2a.1 The Service is a general-purpose tool. You alone determine what Tasks you submit, the purpose for which you use the Service, and the websites, applications or systems in connection with which you use any Output. We do not select, direct, recommend, monitor or control those targets, and we have no knowledge of, or involvement in, any particular use you make of the Service.

2a.2 Nothing in these Terms creates any partnership, joint venture, agency, employment or fiduciary relationship between you and us. Neither party has authority to bind the other or to incur any obligation on the other's behalf.

2a.3 Outputs are returned to you as neutral technical results. You are solely responsible for your use of any Output, including for obtaining any permission required from the owner or operator of any website, application or system to which you apply it.

3.1 You must be at least eighteen (18) years of age and have full legal capacity to enter into a binding contract to use the Service.

3.2 You must provide accurate, current and complete information when registering an Account and keep that information up to date.

3.3 You are responsible for maintaining the confidentiality of your Account credentials and for all activity that occurs under your Account, whether or not authorised by you. You must notify us promptly at [email protected] of any unauthorised access to or use of your Account.

3.4 Your Account is personal to you or to the organisation on whose behalf it was registered. You may not transfer, assign or share it without our prior written consent.

4.1 You must not, and must not permit or assist any other person to, use the Service to:

• (a) violate any applicable law or regulation, or facilitate any activity that does so;
• (b) breach the terms of service, terms of use or other contractual terms of any third-party website, application or platform;
• (c) circumvent rate limits, quotas, access controls or other usage restrictions, whether imposed by us or by any Third Party;
• (d) gain unauthorised access to any computer system, account, network or data;
• (e) launch, participate in or facilitate any distributed denial-of-service (DDoS) attack or other attack on the availability of any system;
• (f) send, post or facilitate any unsolicited bulk communications, including bulk email, comments, messages or image posts;
• (g) create accounts in bulk, manipulate votes, reviews, ticket sales or other limited-availability systems, or engage in credential stuffing or account takeover;
• (h) impersonate any person or entity, or engage in any fraudulent, deceptive or misleading conduct;
• (i) infringe or misappropriate the intellectual property, privacy or other rights of any person; or
• (j) engage in any other conduct that could expose us, our suppliers or other users to legal liability or reputational harm.

4.2 You must not reverse engineer, decompile, disassemble, probe, scan or test the vulnerability of the Service, except to the extent that such restriction is prohibited by applicable law.

4.3 You must not resell, sublicense, white-label or redistribute the Service or any Output as your own, or make the Service available to any Third Party, without our prior written consent.

4.4 Any breach of this Section 04 is a material breach of these Terms and may result in the measures described in Sections 05 and 18.

5.1 We take unlawful and non-compliant use of the Service seriously. Where we receive a report of, or otherwise identify, suspected unlawful or non-compliant use, we may investigate the relevant conduct and may suspend the relevant Account and API Keys pending the outcome of that investigation.

5.2 Where we reasonably determine that you have breached these Terms or applicable law, we may take any measure we consider appropriate, including permanent termination of your Account under Section 18 and disclosure of information under Section 07.

5.3 This Section 05 applies to conduct that we have identified and investigated. Where we act on a Third Party notice or claim without having determined its merits, Section 05a applies instead.

5a.1 If we receive a complaint, notice or claim from a Third Party alleging that your use of the Service, your Account, an API Key or an application connected to the Service infringes that Third Party's rights or is unlawful, we may immediately restrict or suspend the affected Account, API Key, application and Balance, without prior notice to you.

5a.2 We are not required to investigate, adjudicate or determine the merits of any such claim before acting. Any restriction under this Section 05a is a precautionary measure and does not constitute an admission of liability, infringement or wrongdoing by us or by you.

5a.3 Where reasonably practicable and lawful, we will notify you of the restriction and give you an opportunity to respond to the claim.

5a.4 If the claim is withdrawn, or we determine that it is unfounded, we will lift the restriction within a reasonable time and your Balance will be restored. No refund, credit, pro-rata payment or other compensation is owed for any period during which a restriction under this Section 05a was in effect.

6.1 We may, at any time and at our sole discretion, require you to complete a Know Your Customer ("KYC") or other verification process as a condition of providing or continuing to provide the Service.

6.2 A KYC process may include requests for government-issued identification, proof of address, corporate registration documents, information about your intended use of the Service, or any other information we reasonably consider necessary.

6.3 We may decline to provide, or may suspend or discontinue, the Service if you fail to complete a KYC process to our reasonable satisfaction. Information collected through a KYC process is handled in accordance with Section 07 and our Privacy Policy.

7.1 We may disclose information about you, including Account details and records of your use of the Service, to law enforcement authorities, regulators, courts or affected rights holders, without your consent, where:

• (a) we are required or permitted to do so by applicable law, regulation or legal process;
• (b) it is reasonably necessary to respond to an abuse report or to investigate suspected unlawful or non-compliant use of the Service;
• (c) it is reasonably necessary to establish, exercise or defend our legal rights or protect our property; or
• (d) it is reasonably necessary to prevent harm to any person.

7.2 We may also share information with service providers who process it on our behalf to operate the Service, subject to appropriate confidentiality obligations.

7.3 All processing of personal data is carried out in accordance with applicable data protection law, including the Personal Data Protection Act 2012 of Singapore, and our Privacy Policy.

8.1 If you are a rights holder and believe that the Service is being used to infringe your rights, you may notify us at [email protected]. Your notice must contain sufficient detail to allow us to identify the conduct concerned.

8.2 Where we determine, at our sole discretion, that an Account has been used to infringe your rights, we may terminate that Account, disclose to you information we hold about the responsible user to the extent permitted by applicable law, and provide reasonable assistance in remedying the harm caused.

8.3 This Section 08 is without prejudice to Section 07.

9.1 We oppose cybercrime in all its forms. If you operate an anti-bot, anti-abuse, or threat-intelligence service and identify abuse of the Service, you may notify us at [email protected].

9.2 Where we verify an abuse report, we will terminate the responsible customer's Account and bar that customer from any future use of the Service, in accordance with Section 05. We treat verified abuse reports from the anti-bot community as a priority.

If you consider any link on our website objectionable, you may contact us at [email protected]. We will review all link removal requests, but we are under no obligation to remove any link or to respond to you directly.

11.1 You are solely responsible for safeguarding your API Keys. You must treat them as confidential credentials and must not share, publish, sell or otherwise disclose them.

11.2 You are responsible and liable for all activity carried out using your API Keys, including activity by any person you did not authorise, until you notify us of the compromise in accordance with Section 3.3.

11.3 We may suspend, rotate or revoke any API Key at any time, including where we reasonably believe it has been leaked, compromised or misused.

12.1 We do not guarantee any particular solve outcome, solve rate, response time or the correctness of any Output.

12.2 Captcha systems are operated by Third Parties and change frequently. A Task may fail, return an incorrect Output or take longer than expected. Billing for failed Tasks is governed by Section 14.

13.1 The Service is subject to rate limits and usage quotas, which may vary by Account, Balance and service tier and may be changed by us at any time.

13.2 We may throttle, queue or reject requests that exceed applicable limits. Repeated or sustained attempts to exceed or circumvent those limits may result in revocation of API Keys or suspension of your Account under Section 18.

14.1 Payments are processed by third-party payment processors, and may be subject to those processors' own terms. We do not store your full payment credentials.

14.2 All prices are stated exclusive of any applicable taxes, which are your responsibility unless we are required by law to collect them.

14.3 Purchases of Balance are final and non-refundable, except as required by applicable law or as expressly stated in these Terms. A Task that finishes as failed automatically returns its original charge once to your Balance; unpaid pay-as-you-go debt is cancelled and any repaid portion returns to your Balance. A failed subscription Task restores one solve without extending or reactivating the subscription. Successful Tasks retain their charge. We may issue additional credits for billing errors.

14.4 Balance has no cash value, is not transferable, and does not bear interest.

14.5 We may change our prices at any time. Price changes apply only to purchases made after the new prices are published.

15.1 We do not guarantee that the Service will be uninterrupted, timely, secure or error-free.

15.2 The Service may be unavailable from time to time due to maintenance, upgrades, capacity constraints or failures of third-party infrastructure outside our control. We will use reasonable efforts to give advance notice of planned maintenance where practicable. Our liability for unavailability is subject to Section 17.

You shall defend, indemnify and hold harmless SurSolver and its affiliates, directors, officers, employees and agents from and against all claims, demands, proceedings, losses, damages, liabilities, fines, costs and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service or any Output; (b) your breach of these Terms; (c) your violation of any applicable law or the rights of any Third Party; or (d) any claim brought by a Third Party affected by your use of the Service.

17.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SURSOLVER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL OR DATA, HOWEVER CAUSED AND WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EVEN IF ADVISED OF THEIR POSSIBILITY.

17.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SURSOLVER'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO SURSOLVER IN THE THIRTY (30) DAYS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

17.3 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence.

18.1 You may stop using the Service and close your Account at any time.

18.2 We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without cause and with or without notice, including where we reasonably believe that you have breached these Terms.

18.3 Any remaining Balance on an Account terminated for your breach of these Terms is handled in accordance with Section 14. Any Balance withheld under a restriction imposed under Section 05a is governed by Section 05a and not by Section 14.

18.4 Sections 02a, 05a, 07, 11.2, 14, 16, 17, 18, 19, 22 and 23, and any other provision which by its nature is intended to survive, shall survive any termination or expiry of these Terms.

19.1 These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or the Service, are governed by the laws of the Republic of Singapore, without regard to conflict-of-law principles.

19.2 The courts of the Republic of Singapore shall have exclusive jurisdiction to settle any such dispute or claim, and each party irrevocably submits to that jurisdiction.

20.1 We may amend these Terms at any time. The current version will always be available on this page, with its "last updated" date shown at the top.

20.2 Where we make a material change, we will use reasonable efforts to notify you by email or through the Service at least seven (7) days before the change takes effect, unless the change is required by law or to address abuse or security risks, in which case it may take effect immediately.

20.3 Your continued use of the Service after a change takes effect constitutes your acceptance of the amended Terms. If you do not agree to the amended Terms, you must stop using the Service.

We shall not be liable for any failure or delay in performing our obligations under these Terms to the extent caused by events beyond our reasonable control, including natural disasters, acts of government, war, terrorism, civil unrest, labour disputes, epidemics, power or internet outages, cyber-attacks, or failures of third-party service providers.

23.1 Entire agreement. These Terms, together with our Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements, representations and understandings.

23.2 Severability. If any provision of these Terms is held invalid, illegal or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

23.3 No waiver. Our failure or delay in enforcing any right or provision of these Terms shall not constitute a waiver of that right or provision.

23.4 Assignment. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition or sale of assets.

23.5 Third-party rights. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 of Singapore to enforce any of its terms.

23.6 Notices. We may give notices to you by email to the address associated with your Account or by posting them within the Service. You must send notices to us at [email protected].

23.7 Language. These Terms are written in English. If they are translated into any other language, the English version shall prevail in the event of any conflict or inconsistency.
